Genel Olarak Tahliye Taahh\u00fcd\u00fc<\/strong><\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesi, TBK m.299 vd. d\u00fczenlenmektedir. Buna g\u00f6re, kira s\u00f6zle\u015fmesi genel h\u00fck\u00fcmlere tabi (adi) kira, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131 ile \u00fcr\u00fcn kiras\u0131 olmak \u00fczere \u00fc\u00e7 ana kola ayr\u0131lmaktad\u0131r. Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda s\u00f6zle\u015fmenin sona ermesi ise esas itibariyle TBK m. 347 vd. h\u00fck\u00fcmlerinde d\u00fczenlenmektedir. Bu kapsamda, kira s\u00f6zle\u015fmesi iki \u015fekilde sona erdirilebilmekte olup bunlar bildirim veya dava \u015feklindedir. Kira s\u00f6zle\u015fmesinin dava yoluyla sona erdiren sebepler s\u0131n\u0131rl\u0131 say\u0131 ilkesine tabii olup geni\u015fletilemezler.<\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesi kiraya verenden veya kirac\u0131dan kaynaklanan sebeplerle sona erdirilebilir. Kiraya verenden kaynaklanan sebepler, kiraya verenin veya yeni malikin gereksinimi, kiralanan\u0131n yeniden in\u015fas\u0131 ve imar\u0131 olabilir. Kirac\u0131dan kaynaklanan sebepler ise yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fc, kirac\u0131n\u0131n kira bedelini \u00f6dememesi nedeniyle iki hakl\u0131 ihtar sonucunda d\u00fc\u015ft\u00fc\u011f\u00fc temerr\u00fct ve kirac\u0131n\u0131n veya birlikte ya\u015fad\u0131\u011f\u0131 e\u015finin ayn\u0131 il\u00e7ede oturmaya elveri\u015fli konutunun bulunmas\u0131 durumudur.<\/p>\n\n\n\n<p>Yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fc 6570 say\u0131l\u0131 m\u00fclga Gayrimenkul Kiralar\u0131 Hakk\u0131nda Kanun m.7\/1-a h\u00fckm\u00fcnde d\u00fczenlenmi\u015fti. B\u00f6ylece, kirayalan\u0131n \u201c<em>a) kirac\u0131 taraf\u0131ndan gayrimenkul\u00fcn tahliye edilece\u011fi yaz\u0131 ile bildirilmi\u015f olmas\u0131na ra\u011fmen tahliye edilmezse icra dairesine m\u00fcracaatla tahliye isteyebilece\u011fi<\/em>\u201d \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fc. Ayn\u0131 konuya ili\u015fkin benzer bir d\u00fczenleme konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiras\u0131 bak\u0131m\u0131ndan TBK. m. 352\/I\u2019de yer almaktad\u0131r. Buna g\u00f6re, \u201c<em>kirac\u0131, kiralanan\u0131n teslim edilmesinden sonra, kiraya verene kar\u015f\u0131, kiralanan\u0131 belli bir tarihte bo\u015faltmay\u0131 yaz\u0131l\u0131 olarak \u00fcstlendi\u011fi h\u00e2lde bo\u015faltmam\u0131\u015fsa kiraya veren, kira s\u00f6zle\u015fmesini bu tarihten ba\u015flayarak bir ay i\u00e7inde icraya ba\u015fvurmak veya dava a\u00e7mak suretiyle sona erdirebilir<\/em>\u201d.<\/p>\n\n\n\n<p>Bu noktada \u00f6nemle belirtilmelidir ki, yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fc ancak konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131 bak\u0131m\u0131ndan d\u00fczenlenmekte olup <strong>genel h\u00fck\u00fcmlere tabii kira s\u00f6zle\u015fmeleri<\/strong> ile <strong>\u00fcr\u00fcn kiralar\u0131na ili\u015fkin s\u00f6zle\u015fmelerde<\/strong> yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fc <strong>ge\u00e7erli olmamaktad\u0131r.<\/strong><\/p>\n\n\n\n<p><strong>\u00d6rne\u011fin, <\/strong>has\u0131lat kiralar\u0131 TBK\u2019n\u0131n 357 vd. maddelerinde d\u00fczenlenmi\u015ftir. \u00d6ncelikle, TBK\u2019n\u0131n 358\u2019de maddesinde \u201c<em>Bu ayr\u0131mda \u00fcr\u00fcn kiras\u0131na ili\u015fkin \u00f6zel h\u00fck\u00fcm bulunmad\u0131k\u00e7a, kira s\u00f6zle\u015fmesine ili\u015fkin genel h\u00fck\u00fcmler uygulan\u0131r.<\/em>\u201d \u015feklinde at\u0131fta bulunulmu\u015ftur. \u00dcr\u00fcn kiralar\u0131nda s\u00f6zle\u015fmenin sona erme nedenleri ise kanunda s\u0131n\u0131rlay\u0131c\u0131 say\u0131m \u015feklinde say\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re, s\u00fcrenin ge\u00e7mesi, taraflar\u0131n fesih bildirimi yoluyla kira ili\u015fkisini sona erdirmesi, \u00f6nemli sebepler, kirac\u0131n\u0131n iflas\u0131, kirac\u0131n\u0131n \u00f6l\u00fcm\u00fc has\u0131lat kira s\u00f6zle\u015fmesini sona erdirmektedir. Bu durumda g\u00f6r\u00fclebilece\u011fi \u00fczere TBK m.352\/1\u2019e hem a\u00e7\u0131k\u00e7a bir at\u0131f yap\u0131lmam\u0131\u015f hem de s\u00f6z konusu madde h\u00fckm\u00fc kira s\u00f6zle\u015fmesinin \u00f6zel h\u00fck\u00fcmleri aras\u0131nda yer almaktad\u0131r. Nitekim doktrinde de \u201c\u2026<em><strong>Bu noktada \u015fu hususun belirtilmesi gerekmektedir. Tahliye taahh\u00fcd\u00fc yaln\u0131zca konut ve \u00e7at\u0131l\u0131 i\u015fyerleri bak\u0131m\u0131ndan verilebilmektedir. Konut ve \u00e7at\u0131l\u0131 i\u015fyerleri kira s\u00f6zle\u015fmelerine konu yerler d\u0131\u015f\u0131ndaki ta\u015f\u0131nmazlar hakk\u0131nda tahliye taahh\u00fcd\u00fcnde bulunulamaz<\/strong>.<\/em>\u201d \u015feklinde belirtilmi\u015ftir. Kirac\u0131dan Al\u0131nan Yaz\u0131l\u0131 Tahliye Taahh\u00fctnamesinin Kira S\u00f6zle\u015fmesine Etkisi)<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Yarg\u0131tay Hukuk Genele Kurulu E.2017\/975, K.2021\/1108 K. karar\u0131 \u201c<em>Tahliye taahh\u00fcd\u00fc yaln\u0131zca konut ve \u00e7at\u0131l\u0131 i\u015fyerleri kira s\u00f6zle\u015fmesine konu yerler i\u00e7in verilir. Konut ve \u00e7at\u0131l\u0131 i\u015fyerleri kira s\u00f6zle\u015fmesine konu yerler d\u0131\u015f\u0131ndaki ta\u015f\u0131nmazlar hakk\u0131nda tahliye taahh\u00fcd\u00fcnde bulunulamaz (Ceran, Mithat: Kira S\u00f6zle\u015fmesi ve Tahliye Davalar\u0131, Ankara 2019, s. 1002).<\/em>\u201d \u015eeklindedir.<\/p>\n\n\n\n<p><strong>\u00d6zetle; has\u0131lat kiras\u0131na ili\u015fkin bir ta\u015f\u0131nmaz i\u00e7in yaz\u0131l\u0131 tahliye taahh\u00fctnamesi verilememektedir.<\/strong><\/p>\n\n\n\n<p>Esasen yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fcnden maksat, kirac\u0131n\u0131n kiraya verene kar\u015f\u0131 kiralanan\u0131 belirli bir tarihte bo\u015faltmay\u0131 kiralan\u0131n tesliminden sonra \u00fcstlendi\u011fi yaz\u0131l\u0131 \u015fekle tabii bir i\u015flemdir. B\u00f6ylece, kiraya vere ba\u015fka bir sebebin varl\u0131\u011f\u0131na gerek olmaks\u0131z\u0131n ve herhangi bir tazminat \u00f6demeksizin kira ili\u015fkisini sona erdirme imkan\u0131n\u0131 elde eder.<\/p>\n\n\n\n<p><strong>2. Tahliye Taahh\u00fcd\u00fcn\u00fcn Ge\u00e7erlili\u011fi<\/strong><\/p>\n\n\n\n<p>Tahliye taahh\u00fctnamesinin birden fazla ge\u00e7erlilik \u015fart\u0131 bulunmaktad\u0131r. Bu \u015fartlar;<\/p>\n\n\n\n<p>a. Yaz\u0131l\u0131 olmas\u0131,<\/p>\n\n\n\n<p>b. Kirac\u0131n\u0131n serbest iradesine dayanmas\u0131,<\/p>\n\n\n\n<p>c. Kira s\u00f6zle\u015fmesinin imzalanmas\u0131ndan ve kira s\u00f6zle\u015fmesine konu konut veya i\u015fyerinin kirac\u0131ya teslim edilmesi sonras\u0131nda imzalanm\u0131\u015f olmas\u0131,<\/p>\n\n\n\n<p>d. Tahliye tarihinin, taahh\u00fctnamenin imzaland\u0131\u011f\u0131 a\u015famada belirtilmi\u015f olmas\u0131d\u0131r. (<strong>Ancak tarihin sonradan dolduruldu\u011funa y\u00f6nelik itiraz\u0131n kirac\u0131 taraf\u0131ndan ispatlanmas\u0131 gerekmektedir.<\/strong>)<\/p>\n\n\n\n<p>Her ne kadar tahliye taahh\u00fcd\u00fc adi yaz\u0131l\u0131 \u015fekle tabi olmakla beraber ispat kolayl\u0131\u011f\u0131 bak\u0131m\u0131ndan tahliye taahh\u00fcd\u00fcn\u00fcn noter taraf\u0131ndan d\u00fczenleme veya onaylama \u015feklinde yap\u0131lmas\u0131 da m\u00fcmk\u00fcn olup bu durumda kirac\u0131, tahliye taahh\u00fcd\u00fcnde yer alan imzas\u0131n\u0131 \u0130cra ve \u0130flas Kanunu m.275\/2 h\u00fckm\u00fc uyar\u0131nca inkar edemez. Bu durumda resmi bir senetteki imzan\u0131n inkar\u0131 yoluna gidilmek istenirse HMK m.208\/4 h\u00fckm\u00fc uyar\u0131nca sahtelik davas\u0131 a\u00e7\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Yaz\u0131l\u0131 \u015fekil \u015fart\u0131 bizzat kirac\u0131 taraf\u0131ndan yerine getirilmi\u015f olmal\u0131d\u0131r. Kirac\u0131 d\u0131\u015f\u0131ndaki kimselerin b\u00f6yle bir taahh\u00fcd\u00fc imzalam\u0131\u015f olmas\u0131 hukuk\u00ee sonu\u00e7 do\u011furmaz. <\/p>\n\n\n\n<p><strong>Kiralanan aile konutu niteli\u011finde ise kirac\u0131 e\u015fin yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fc verebilmesi i\u00e7in di\u011fer e\u015fin a\u00e7\u0131k r\u0131zas\u0131 gerekmelidir.<\/strong><\/p>\n\n\n\n<p><strong>Kira s\u00f6zle\u015fmesinde birden fazla kirac\u0131 varsa, tahliye borcu b\u00f6l\u00fcnemeyen bir bor\u00e7 olmas\u0131 nedeniyle tahliye taahh\u00fctnamesinde her bir kirac\u0131n\u0131n imzas\u0131 bulunmal\u0131d\u0131r.<\/strong><\/p>\n\n\n\n<p><strong>3. Tahliye Taahh\u00fcd\u00fc ve Beyaza \u0130mza<\/strong><\/p>\n\n\n\n<p>Uygulamada konut veya i\u015fyeri sahipleri, kirac\u0131dan kira s\u00f6zle\u015fmesinin imzaland\u0131\u011f\u0131 anda tahliye tarihinin bo\u015f oldu\u011fu bir taahh\u00fctname almaktad\u0131rlar. Tahliye taahh\u00fcd\u00fcn\u00fcn bo\u015f olarak verilmesi ve kiraya veren taraf\u0131ndan doldurulmas\u0131 halinde<strong> beyaza imza<\/strong> s\u00f6z konusudur. Yarg\u0131tay\u2019a g\u00f6re, <strong>tahliye taahh\u00fcd\u00fcn\u00fcn kiralanan\u0131n tesliminden \u00f6nce beyaza imza \u015fekilde imzalat\u0131ld\u0131\u011f\u0131 hususunda ispat y\u00fck\u00fc davac\u0131ya <\/strong>d\u00fc\u015fmektedir.<\/p>\n\n\n\n<p>Yarg\u0131tay Hukuk Genel Kurulu E.2017\/975 K.2021\/1108 ve 28.09.2021 tarihli karar\u0131 &#8220;.<em>..4721 say\u0131l\u0131 T\u00fcrk Medeni Kanunu\u2019nun (TMK) \u201c\u0130spat y\u00fck\u00fc\u201d ba\u015fl\u0131kl\u0131 6. maddesinde; kanunda aksine bir h\u00fck\u00fcm bulunmad\u0131k\u00e7a, taraflardan her biri, hakk\u0131n\u0131 dayand\u0131rd\u0131\u011f\u0131 olgular\u0131n varl\u0131\u011f\u0131n\u0131 ispatla y\u00fck\u00fcml\u00fc tutulmu\u015ftur. \u0130spat y\u00fck\u00fcn\u00fc d\u00fczenleyen 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu\u2019nun (HMK) 190. maddesi \u201c(1) \u0130spat y\u00fck\u00fc, kanunda \u00f6zel bir d\u00fczenleme bulunmad\u0131k\u00e7a, iddia edilen vak\u0131aya ba\u011flanan hukuki sonu\u00e7tan kendi lehine hak \u00e7\u0131karan tarafa aittir. Kanuni bir karineye dayanan taraf, sadece karinenin temelini olu\u015fturan vak\u0131aya ili\u015fkin ispat y\u00fck\u00fc alt\u0131ndad\u0131r. Kanunda \u00f6ng\u00f6r\u00fclen istisnalar d\u0131\u015f\u0131nda, kar\u015f\u0131 taraf, kanuni karinenin aksini ispat edebilir\u201d \u015feklindedir. Yukar\u0131da belirtilen maddenin birinci f\u0131kras\u0131nda, ispat y\u00fck\u00fcn\u00fcn belirlenmesine ili\u015fkin temel kural vurgulanm\u0131\u015ft\u0131r. Buna g\u00f6re, bir vak\u0131aya ba\u011flanan hukuk\u00ee sonu\u00e7tan kendi lehine hak \u00e7\u0131karan taraf ispat y\u00fck\u00fcn\u00fc ta\u015f\u0131yacakt\u0131r. Her somut olaydaki maddi vak\u0131aya g\u00f6re lehine hak \u00e7\u0131karan taraf ve ispat y\u00fck\u00fc \u015fekillenece\u011finden, maddi hukuk kural\u0131na ili\u015fkin bu vak\u0131alar\u0131n do\u011fru ve net bir \u015fekilde belirlenerek ortaya konulmas\u0131 gerekmektedir. Maddede aksine d\u00fczenleme olmad\u0131k\u00e7a ibaresi eklendi\u011finden, kanunda ispat y\u00fck\u00fc ile ilgili \u00f6zel bir d\u00fczenlemeye yer verildi\u011finde, ispat y\u00fck\u00fc genel kurala g\u00f6re de\u011fil de kanunda belirtilen \u00f6zel d\u00fczenlemeye g\u00f6re belirlenecektir. Kural olarak, bir vak\u0131adan kendi lehine haklar \u00e7\u0131karan\/iddia eden taraf, o vak\u0131ay\u0131 ispat etmeye mecburdur (TMK m. 6). <strong>Kira s\u00f6zle\u015fmesinin yap\u0131lmas\u0131 s\u0131ras\u0131nda tarihleri bo\u015f olan ve kirac\u0131 taraf\u0131ndan imzalanan tahliye taahh\u00fcd\u00fc al\u0131nmas\u0131 durumunda, bu belgenin kiralanan\u0131n teslimi \u00f6ncesinde tarihlerinin bo\u015f olarak verildi\u011fi ve anla\u015fmaya ayk\u0131r\u0131 olarak sonradan tamamland\u0131\u011f\u0131na ili\u015fkin savunman\u0131n kan\u0131tlanmas\u0131 gerekir. Bu \u015fekilde yani d\u00fczenleme ve bo\u015faltma tarihlerinin sonradan tamamlanmas\u0131 belgenin ge\u00e7ersizli\u011fini gerekmedi\u011fi gibi bu tarihlerin anla\u015fmaya ayk\u0131r\u0131 olarak tamamland\u0131\u011f\u0131na ili\u015fkin iddia kirac\u0131 taraf\u0131ndan ispatlanmal\u0131d\u0131r. (<\/strong>Kan\u0131k, s. 1293)&#8230;<\/em>.&#8221; \u015feklindedir.<\/p>\n\n\n\n<p>Nitekim Yarg\u0131tay 6. Hukuk Dairesi E.2008\/11 K.2008\/2784 ve 11.03.2008 tarihli karar\u0131 &#8220;<em><strong>&#8230;\u00d6te yandan at\u0131lan imza, imza sahibi kirac\u0131y\u0131 ba\u011flayaca\u011f\u0131ndan tahliye taahh\u00fcd\u00fcn\u00fc i\u00e7eren bu belgedeki tarihlerin sonradan dolduruldu\u011fu yolundaki itiraza itibar edilemez. <\/strong>Taahh\u00fctnamedeki tanzim tarihinin bo\u015f olarak b\u0131rak\u0131l\u0131p davac\u0131ya verildi\u011finin kabul edilmesi halinde dahi daval\u0131 kirac\u0131 bu \u015fekildeki davran\u0131\u015f\u0131n\u0131n sonucuna katlanmak zorundad\u0131r. Tanzim tarihinin sonradan doldurulmu\u015f olmas\u0131n\u0131n sonuca etkisi bulunamamaktad\u0131r. Takip s\u00fcresinde yap\u0131l\u0131p dava a\u00e7\u0131ld\u0131\u011f\u0131na g\u00f6re serbest irade ile kiralananda oturulurken verilen tahliye taahh\u00fcd\u00fcn\u00fcn ge\u00e7erli oldu\u011funun kabul\u00fcyle kiralanan\u0131n tahliyesine karar verilmesi gerekirken&#8230;<\/em>&#8221; \u015feklindedir.<\/p>\n\n\n\n<p><strong>4. Tahliye Taahh\u00fcd\u00fc ve \u0130rade Fesad\u0131<\/strong><\/p>\n\n\n\n<p>Kanunda kirac\u0131n\u0131n serbest iradesine dayanmayan tahliye taahh\u00fctnamesinin iptal edilece\u011fine y\u00f6nelik a\u00e7\u0131k\u00e7a bir d\u00fczenleme bulunmamaktad\u0131r. Ancak doktrinde bu durum \u201c<em>Kirac\u0131 taraf\u0131ndan verilen tahliye taahh\u00fcd\u00fcn\u00fcn ge\u00e7erli olabilmesi i\u00e7in, hata, hile ve tehdit (ikrah) sebebi ile verilmemi\u015f olmas\u0131 gerekir. \u0130rade sakatl\u0131klar\u0131 sebebiyle verilen tahliye taahh\u00fcd\u00fcn\u00fcn ge\u00e7ersizli\u011fi ileri s\u00fcr\u00fclebilir ve bu iddia her t\u00fcrl\u00fc delil ile de ispatlanabilir. Tahliye taahh\u00fcd\u00fc irade sakatl\u0131klar\u0131 sebebiyle verildi\u011fi durumda bu konuyu d\u00fczenleyen kira hukukunda \u00f6zel bir d\u00fczenleme bulunmad\u0131\u011f\u0131nda, burada da TMK m.5\u2019e g\u00f6re Bor\u00e7lar Kanunu\u2019nun irade sakatl\u0131klar\u0131n\u0131 d\u00fczenleyen h\u00fck\u00fcmleri uygulanacakt\u0131r. \u0130rade sakatl\u0131klar\u0131 sebebiyle, tahliye taahh\u00fcd\u00fcn\u00fcn ge\u00e7ersizli\u011fini \u00f6ne s\u00fcren kirac\u0131, bu y\u00f6ndeki ge\u00e7ersizlik iradesini Bor\u00e7lar Kanunu\u2019na g\u00f6re 1 y\u0131ll\u0131k s\u00fcre i\u00e7erisinde a\u00e7\u0131klamas\u0131 gerekecektir. Ge\u00e7ersizlik hakk\u0131, tek tarafl\u0131 ve kar\u015f\u0131 tarafa ula\u015fmas\u0131 gerekli bir irade a\u00e7\u0131klamas\u0131 ile kullan\u0131l\u0131r. \u0130rade a\u00e7\u0131klamas\u0131, kar\u015f\u0131 tarafa ula\u015ft\u0131\u011f\u0131 andan itibaren taahh\u00fct kesin h\u00fck\u00fcms\u00fcz olur. Ge\u00e7ersizlik iradesinin a\u00e7\u0131klanmas\u0131 herhangi bir \u015fekle tabi de\u011fildir ve dava a\u00e7\u0131lmas\u0131na da gerek yoktur.\u201d<\/em> (YALMAN, S\u00fcleyman. Tahliye Sebebi Olarak Yaz\u0131l\u0131 Tahliye Taahh\u00fcd\u00fc, Sel\u00e7uk \u00dcniversitesi Hukuk Fak\u00fcltesi Dergisi, Cilt:13, Say\u0131:2 Y\u0131l:2005)<\/p>\n\n\n\n<p>Doktrinde iptal davas\u0131 a\u00e7\u0131lmas\u0131 y\u00f6n\u00fcnde de g\u00f6r\u00fc\u015fler mevcuttur.<\/p>\n\n\n\n<p>Tahliye taahh\u00fctnamesinin kira s\u00f6zle\u015fmesinin imzalanmas\u0131 s\u0131ras\u0131nda \u00f6n \u015fart olarak ileri s\u00fcr\u00fclmesi ve tahliye taahh\u00fcd\u00fcn\u00fcn de bo\u015f b\u0131rak\u0131lmas\u0131 durumunda <strong>manevi cebir alt\u0131nda imzaland\u0131\u011f\u0131 \u00f6ne s\u00fcr\u00fcld\u00fc\u011f\u00fcnde, kirac\u0131n\u0131n i\u015fbu durumu ispat etmesi gerekmektedir. <\/strong>Yarg\u0131tay 6. Hukuk Dairesi E.2015\/7313 K.2015\/9971 ve T.16.11.2015 \u201c<em>Davac\u0131 vekili dava dilek\u00e7esinde; 05.03.2010 ba\u015flang\u0131\u00e7 tarihli ve 2 y\u0131l s\u00fcreli s\u00f6zle\u015fme ile kirac\u0131 olan daval\u0131n\u0131n 14.03.2013 tarihli tahliye taahh\u00fctnamesi ile kiralanan\u0131 04.03.2014 tarihinde tahliye edece\u011fini taahh\u00fct etmesine ra\u011fmen bu tarihte tahliye etmedi\u011fini belirterek tahliye taahh\u00fct\u00fc sebebiyle kiralanan\u0131n tahliyesini istemi\u015ftir. Daval\u0131 vekili tahliye taahh\u00fctnamesinin kira s\u00f6zle\u015fmesinin imzalanmas\u0131ndan <strong>\u00f6nce bo\u015f ve tarihsiz olarak al\u0131nd\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n \u00f6n \u015fart olarak taahh\u00fctnameyi imzalatmak istedi\u011fini belirterek manevi cebir alt\u0131nda al\u0131nan tahliye taahh\u00fctnamesinin ge\u00e7ersiz oldu\u011funu<\/strong> ve davan\u0131n reddini savunmu\u015ftur. Mahkemece kiralanan\u0131n yarg\u0131lama s\u0131ras\u0131nda tahliye edilmesi sebebiyle dava konusuz kald\u0131\u011f\u0131ndan davan\u0131n esas\u0131 hakk\u0131nda karar verilmesine yer olmad\u0131\u011f\u0131na ve davac\u0131n\u0131n dava a\u00e7makta hakl\u0131 olmad\u0131\u011f\u0131 gerek\u00e7esiyle yarg\u0131lama giderlerinden sorumlu tutulmas\u0131na karar verilmi\u015ftir. &#8230;nun 190. Maddesi uyar\u0131nca <strong>ispat y\u00fck\u00fc, iddia edilen vak\u0131aya ba\u011flanan hukuki sonu\u00e7tan kendi lehine hak \u00e7\u0131karan tarafa aittir. Tahliye taahh\u00fctnamesinin kira s\u00f6zle\u015fmesinden \u00f6nce imzalat\u0131ld\u0131\u011f\u0131n\u0131 iddia eden daval\u0131 bu iddias\u0131n\u0131 ispat etmekle y\u00fck\u00fcml\u00fc olup<\/strong>\u2026\u201d<\/em> \u015feklindedir.<\/p>\n\n\n\n<p>Doktrinde tahliye taahh\u00fcd\u00fcn\u00fcn bask\u0131 alt\u0131nda olu\u015fturulmas\u0131 durumunda ancak bu durumun yaz\u0131l\u0131 delille ispatlanaca\u011f\u0131na y\u00f6nelik g\u00f6r\u00fc\u015fler de mevcuttur. \u201c<em>Senedin (tahliye taahh\u00fcd\u00fcn\u00fcn) bask\u0131 alt\u0131nda ve s\u00f6zle\u015fmeyle, kiralan\u0131n tesliminden \u00f6nce verilmi\u015f olmas\u0131n\u0131n ispat y\u00fck\u00fc kirac\u0131ya d\u00fc\u015fmekte ve kirac\u0131, bu hususu her t\u00fcrl\u00fc delille (\u00f6rne\u011fin tan\u0131kla) ispatlayamaz. Hele noterden g\u00f6nderilecek bir ihtarname ile s\u00f6z konusu taahh\u00fcd\u00fcn ge\u00e7ersiz oldu\u011funun bildirilmesi tek ba\u015f\u0131na kiraya verenin bu taahh\u00fcde dayanmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7emeyecektir.<\/em>\u201d (Kira Hukuku, Nihaz Yavuz (Yarg\u0131tay 3. Yarg\u0131tay\u2019\u0131n kararlar\u0131 uyar\u0131nca da bu durumu ispat y\u00fck\u00fc, korunmas\u0131 arzu edilen kirac\u0131 \u00fczerine b\u0131rak\u0131lmakta ve yine mahkemelerce HMK m.200 vd. h\u00fck\u00fcmlerine g\u00f6re yaz\u0131l\u0131 tahliye taahh\u00fctnamesine kar\u015f\u0131 yaz\u0131l\u0131 delille kar\u015f\u0131 ispat yap\u0131laca\u011f\u0131 y\u00f6n\u00fcnde uygulamalar mevcuttur.
