{"id":209,"date":"2023-10-30T10:06:55","date_gmt":"2023-10-30T10:06:55","guid":{"rendered":"https:\/\/www.agorahukuk.com.tr\/?p=209"},"modified":"2025-08-25T19:11:13","modified_gmt":"2025-08-25T19:11:13","slug":"yeniden-kiralama-yasagi","status":"publish","type":"post","link":"https:\/\/www.agorahukuk.com.tr\/index.php\/2023\/10\/30\/yeniden-kiralama-yasagi\/","title":{"rendered":"Yeniden Kiralama Yasa\u011f\u0131"},"content":{"rendered":"\n<p>Yeniden kiralama yasa\u011f\u0131, kiralayandan kaynaklanan sebeplerle bo\u015falt\u0131lan konut veya \u00e7at\u0131l\u0131 i\u015fyerinin, kiralayan\u0131n hakl\u0131 bir sebebinin bulunmamas\u0131 \u015fart\u0131na ba\u011fl\u0131 olarak bo\u015falt\u0131lma tarihinden itibaren \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131 d\u0131\u015f\u0131nda bir \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye kiralanamamas\u0131n\u0131 ifade etmektedir.<\/p>\n\n\n\n<p>Yasa\u011f\u0131n konusunu olu\u015fturan eylem, kiralanan\u0131n eski kirac\u0131dan ba\u015fka bir \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye kiraya verilmesidir. Tahliye sa\u011fland\u0131ktan sonra kiralanan\u0131n kullan\u0131lmadan bo\u015f tutulmas\u0131 ya da kar\u015f\u0131l\u0131ks\u0131z kulland\u0131r\u0131lmas\u0131 yeniden kiralama yasa\u011f\u0131na ayk\u0131r\u0131l\u0131k olu\u015fturmaz.<\/p>\n\n\n\n<p>Yeniden kiralama yasa\u011f\u0131ndan bahsedilebilmesi i\u00e7in;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Gereksinim nedeniyle tahliye<\/li>\n\n\n\n<li>\u0130n\u015fa ve imar nedeniyle tahliye i\u015fleminin yap\u0131lm\u0131\u015f olmas\u0131 gerekmektedir.<\/li>\n<\/ul>\n\n\n\n<p>Kirac\u0131n\u0131n, kiraya verenin talebi sonras\u0131nda kendi r\u0131zas\u0131 veya g\u00f6nderilen ihtarname sonras\u0131nda ta\u015f\u0131nmaz\u0131 bo\u015faltmas\u0131 i\u015fbu tazminat talep edebilmek i\u00e7in yeterli de\u011fildir. Tazminat i\u00e7in tahliye i\u015flemiyle ilgili cebri icra i\u015flemlerine ba\u015flanm\u0131\u015f olunmal\u0131d\u0131r. \u00d6rne\u011fin, sulh hukuk mahkemesinden al\u0131nan tahliye karar\u0131n\u0131n, icra vas\u0131tas\u0131yla tahliye emri g\u00f6nderilmesi gibi. <\/p>\n\n\n\n<p>Yeniden kiralama yasa\u011f\u0131nda, en son y\u0131l ge\u00e7erli olan kira bedeli \u00fczerinden en az 1 y\u0131ll\u0131k kira bedeli kar\u015f\u0131l\u0131\u011f\u0131 tazminat \u00f6denmesi s\u00f6z konusu olabilmektedir. Bu \u00e7er\u00e7evede ilgili maddi tazminat\u0131n kapsam\u0131na;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kira fark\u0131<\/li>\n\n\n\n<li>Ta\u015f\u0131nma giderleri ve komisyoncu giderleri<\/li>\n\n\n\n<li>\u0130\u015fyeri olarak kullan\u0131lan ta\u015f\u0131nmazlarda kar yoksunlu\u011fu,<\/li>\n\n\n\n<li>Kirac\u0131n\u0131n yeni yer i\u00e7in yapm\u0131\u015f oldu\u011fu tadilat giderleri girebilmektedir.<\/li>\n<\/ul>\n\n\n\n<p>\u0130spat hususunda;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00d6ncelikle kiraya verenin gereksinim veya in\u015fa ve imar nedeniyle tahliyeye dayand\u0131\u011f\u0131 hususu ispat edilmeli,<\/li>\n\n\n\n<li>Akabinde kiraya verenin yukar\u0131daki tahliye nedenlerine dayal\u0131 olarak i\u015flem yapmaks\u0131z\u0131n ta\u015f\u0131nmaz\u0131 bir ba\u015fka ki\u015fiye kiralad\u0131\u011f\u0131 ispat edilmeli,<\/li>\n\n\n\n<li>Bunlardan sonra ise maddi tazminat kapsam\u0131nda yukar\u0131da say\u0131lan hususlar belgelendirilerek, en son y\u0131l ge\u00e7erli olan kira bedeli \u00fczerinden <strong>en az <\/strong>1 y\u0131ll\u0131k kira tutar\u0131 tazminat olarak talep edilebilmektedir.<\/li>\n<\/ul>\n\n\n\n<p>G\u00fcncel Yarg\u0131tay kararlar\u0131na g\u00f6re tahliye i\u015fleminin ger\u00e7ekle\u015fmesinden ba\u015flayarak 2 ve 10 y\u0131ll\u0131k zamana\u015f\u0131m\u0131 s\u00fcresi s\u00f6z konusu olacakt\u0131r.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Yeniden kiralama yasa\u011f\u0131, kiralayandan kaynaklanan sebeplerle bo\u015falt\u0131lan konut veya \u00e7at\u0131l\u0131 i\u015fyerinin, kiralayan\u0131n hakl\u0131 bir sebebinin bulunmamas\u0131 \u015fart\u0131na ba\u011fl\u0131 olarak bo\u015falt\u0131lma tarihinden itibaren \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131 d\u0131\u015f\u0131nda bir \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye kiralanamamas\u0131n\u0131 ifade etmektedir.
