{"id":214,"date":"2023-11-13T07:19:17","date_gmt":"2023-11-13T07:19:17","guid":{"rendered":"https:\/\/www.agorahukuk.com.tr\/?p=214"},"modified":"2025-08-25T19:11:13","modified_gmt":"2025-08-25T19:11:13","slug":"idari-gozetim-kararina-itiraz-ve-sinir-disi-etme-kararinin-iptali","status":"publish","type":"post","link":"https:\/\/www.agorahukuk.com.tr\/index.php\/2023\/11\/13\/idari-gozetim-kararina-itiraz-ve-sinir-disi-etme-kararinin-iptali\/","title":{"rendered":"\u0130dari G\u00f6zetim Karar\u0131na \u0130tiraz ve S\u0131n\u0131r D\u0131\u015f\u0131 Etme Karar\u0131n\u0131n \u0130ptali"},"content":{"rendered":"\n<ol class=\"wp-block-list\">\n<li><strong><\/strong><strong>Genel Hususlar<\/strong><\/li>\n<\/ol>\n\n\n\n<p>\u00dclkemize gelen veya \u00fclkemizde bulunan yabanc\u0131 uyruklu ki\u015filerin \u00fclkemizde hangi \u015fartlar alt\u0131nda kalabilece\u011fi, oturum izinleri ve bu izinlerin t\u00fcrleri, hangi hallerde oturum izinlerinin iptal edilebilece\u011fi gibi hususlar 6458 say\u0131l\u0131 Yabanc\u0131lar ve Uluslararas\u0131 Koruma Kanunu\u2019nda h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>\u0130\u015fbu Kanun\u2019un kapsam\u0131, 2.maddede d\u00fczenlenmi\u015f olup buna g\u00f6re, yabanc\u0131larla ilgili i\u015f ve i\u015flemleri; s\u0131n\u0131rlarda, s\u0131n\u0131r kap\u0131lar\u0131nda ya da T\u00fcrkiye i\u00e7inde yabanc\u0131lar\u0131n m\u00fcnferit koruma talepleri \u00fczerine sa\u011flanacak uluslararas\u0131 korumay\u0131, ayr\u0131lmaya zorland\u0131klar\u0131 \u00fclkeye geri d\u00f6nemeyen ve kitlesel olarak T\u00fcrkiye\u2019ye gelen yabanc\u0131lara acil olarak sa\u011flanacak ge\u00e7ici korumay\u0131 sa\u011flamakt\u0131r.<\/p>\n\n\n\n<p>Yine i\u015fbu Kanun\u2019un 4.maddesinde geri g\u00f6nderme yasa\u011f\u0131 d\u00fczenlenmi\u015f olup bu Kanun kapsam\u0131ndaki hi\u00e7 kimse, i\u015fkenceye, insanl\u0131k d\u0131\u015f\u0131 ya da onur k\u0131r\u0131c\u0131 ceza veya muameleye tabii tutulaca\u011f\u0131 veya \u0131rk\u0131, dini, tabiiyeti, belirli bir toplumsal gruba mensubiyeti veya siyasi fikirleri dolay\u0131s\u0131yla hayat\u0131n\u0131n veya h\u00fcrriyetinin tehdit alt\u0131nda bulunaca\u011f\u0131 bir yere g\u00f6nderilemez.<\/p>\n\n\n\n<p>Kanun kapsam\u0131ndaki ikamet izni \u00e7e\u015fitleri ise \u015funlard\u0131r;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>K\u0131sa d\u00f6nem ikamet izni<\/li>\n\n\n\n<li>Aile ikamet izni<\/li>\n\n\n\n<li>\u00d6\u011frenci ikamet izni<\/li>\n\n\n\n<li>Uzun d\u00f6nem ikamet izni<\/li>\n\n\n\n<li>\u0130nsan\u0131 ikamet izni<\/li>\n\n\n\n<li>\u0130nsan ticareti ma\u011fduru ikamet izni.<\/li>\n<\/ul>\n\n\n\n<p>Kanun\u2019da say\u0131lan hallerin varl\u0131\u011f\u0131 halinde ikamet izninin iptal edilmesi yahut ikamet izninin s\u00fcresinin bitmesine ra\u011fmen yenileme ba\u015fvurular\u0131n\u0131n yap\u0131lmamas\u0131 halinde yabanc\u0131 \u015fah\u0131slar, s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131yla men\u015fe \u00fclkesine veya transit gidece\u011fi \u00fclkeye ya da \u00fc\u00e7\u00fcnc\u00fc bir \u00fclkeye s\u0131n\u0131r d\u0131\u015f\u0131 edilebilecektir.<\/p>\n\n\n\n<p>Bu karar, uygulamada genellikle ilgili valili\u011fe ba\u011fl\u0131 il g\u00f6\u00e7 idaresi m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce al\u0131nmaktad\u0131r.<\/p>\n\n\n\n<p>S\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131n ilgili yabanc\u0131ya, yasal temsilcisine veya avukat\u0131na tebli\u011f edilmesi sonras\u0131nda 7 g\u00fcn i\u00e7erisinde s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131 veren valili\u011fin bulundu\u011fu s\u0131n\u0131rlar i\u00e7erisindeki idare mahkemesine s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131n iptali i\u00e7in dava a\u00e7\u0131lmal\u0131d\u0131r. Kanun\u2019un 53.maddesinin 3.f\u0131kras\u0131n\u0131n son c\u00fcmlesi uyar\u0131nca, davan\u0131n a\u00e7\u0131lmas\u0131yla birlikte yabanc\u0131 ki\u015finin r\u0131zas\u0131 hari\u00e7 olmak \u00fczere ki\u015fi hakk\u0131ndaki s\u0131n\u0131r d\u0131\u015f\u0131 etme i\u015flemleri duracakt\u0131r. \u0130dare mahkemesinin s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131n iptali davas\u0131ndaki verdi\u011fi kararlar, kesin olup herhangi bir yarg\u0131 yoluna tabii de\u011fildir.<\/p>\n\n\n\n<p>Uygulamada genellikle yabanc\u0131 hakk\u0131nda s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131n al\u0131nmas\u0131yla birlikte ayn\u0131 anda idari g\u00f6zetim karar\u0131 da al\u0131nmakta olup ki\u015fi geri g\u00f6nderme merkezlerine g\u00f6t\u00fcr\u00fclmektedir. \u0130dari g\u00f6zetim karar\u0131 ilk seferde 6 ay i\u00e7in verilmektedir.<\/p>\n\n\n\n<p>\u0130dari g\u00f6zetim karar\u0131n\u0131n verilmesi sonras\u0131nda i\u015fbu karara kar\u015f\u0131 da sulh ceza hakimli\u011fine itiraz edilebilecektir. Bu itiraz, idari g\u00f6zetim i\u015flemlerini durdurmaz. Sulh ceza hakimi kural olarak 5 g\u00fcn i\u00e7erisinde incelemeyi yap\u0131p karar\u0131n\u0131 verecektir. Sulh ceza hakimli\u011finin bu karar\u0131 da kesin olup kanun yolu denetime tabii de\u011fildir. Ancak, de\u011fi\u015fen durumlar\u0131n olmas\u0131 halinde daha sonra yeniden idari g\u00f6zetim karar\u0131na itiraz edilebilir. Ayn\u0131 zamanda idari g\u00f6zetim karar\u0131, 30 g\u00fcnl\u00fck periyotlar halinde de\u011ferlendirmeye tabiidir.<\/p>\n\n\n\n<p>\u0130dari g\u00f6zetim karar\u0131 yerine alternatif y\u00fck\u00fcml\u00fcl\u00fckler de getirilebilmektedir. Polis merkezinde yap\u0131lan sorgulamada m\u00fcvekkilin ka\u00e7ak stat\u00fcs\u00fcnde oldu\u011funun g\u00f6r\u00fclmesi sonras\u0131nda m\u00fcvekkil, \u2026\u2026\u2026\u2026\u2026.. M\u00fcvekkilin s\u0131n\u0131r d\u0131\u015f\u0131 edilmesi halinde, can g\u00fcvenli\u011fi a\u011f\u0131r ve geri d\u00f6nd\u00fcr\u00fclemez \u015fekilde tehlikeye girecek, \u00e7ocuklar\u0131 T\u00fcrkiye&#8217;de annesi olmadan ya\u015fayacak, 2007 do\u011fumlu olan \u00e7ocu\u011fu 18 ya\u015f\u0131ndan k\u00fc\u00e7\u00fck olmas\u0131 nedeniyle velisi\/vasisi olmadan ikamet izni alamayacak netice olarak da s\u0131n\u0131r d\u0131\u015f\u0131 edilme durumuyla kar\u015f\u0131 kar\u015f\u0131ya kalacakt\u0131r.<\/p>\n\n\n\n<p><strong>2. M\u00fcvekkile ya da ailesine idari g\u00f6zetim karar\u0131n\u0131n ve s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131n ne anlama geldi\u011fi, bu kararlara itiraz edilmemesi halinde ne olaca\u011f\u0131, nas\u0131l itiraz edilece\u011fi, hukuki olarak hangi yollar\u0131n izlenebilece\u011fi, itiraz s\u00fcresi hakk\u0131nda herhangi bir bilgi verilmemi\u015ftir. Kararlar\u0131n m\u00fcvekkile elden tebli\u011f edildi\u011fine ili\u015fkin dosya i\u00e7erisinde tutanak dahi mevcut de\u011fildir. Taraf\u0131m\u0131zca m\u00fcvekkille g\u00f6r\u00fc\u015fmeye gidildi\u011finde m\u00fcvekkil, hangi ama\u00e7la orada tutuldu\u011funu dahi bilmemekte olup geri g\u00f6nderme merkezindeki yasal haklar\u0131 dahi kendisine anlat\u0131l\u0131p bilgilendirilmemi\u015ftir.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;13.12.1995 tarihinde imzalanan, 12.04.1989 tarihli ve 3527 say\u0131l\u0131 Kanun&#8217;la onaylanmas\u0131 uygun bulunan Avrupa \u0130kamet S\u00f6zle\u015fmesi&#8217;nin 3.maddesinin 2.f\u0131kras\u0131 ise \u015fu \u015fekildedir;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2. \u00c2kit Taraflardan birinin, di\u011fer herhangi bir \u00c2kit Taraf \u00fclkesinde yasal olarak iki y\u0131ldan fazla bir s\u00fcredir ikamet etmekte olan uyru\u011fu; milli g\u00fcvenlik a\u00e7\u0131s\u0131ndan kesin zorunluk yoksa, kendisi hakk\u0131ndaki s\u0131n\u0131rd\u0131\u015f\u0131 karar\u0131na kar\u015f\u0131 itirazda bulunmas\u0131na ve bu ama\u00e7la yetkili makama veya yetkili makamca \u00f6zel olarak belirlenmi\u015f ki\u015fi veya ki\u015filere ba\u015fvurmas\u0131na ve bu organlar \u00f6n\u00fcnde temsil olunmas\u0131na m\u00fcsaade edilmeksizin s\u0131n\u0131rd\u0131\u015f\u0131 edilemez.&#8221; \u015e\u00fcphesiz bu f\u0131krada \u00f6ng\u00f6r\u00fclen haklar\u0131n kullan\u0131labilmesi i\u00e7in s\u0131n\u0131r d\u0131\u015f\u0131 i\u015flemine maruz kalacak ki\u015fiye tam ve detayl\u0131 bir \u015fekilde bilgilendirme yap\u0131lmas\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; T\u00fcm bu hususlar g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda iki y\u0131l\u0131 a\u015fk\u0131n s\u00fcredir yasal olarak \u00fclkemizde ikamet eden m\u00fcvekkilin kamu g\u00fcvenli\u011fine tehdit olu\u015fturdu\u011fu iddias\u0131yla soyut ve gerek\u00e7esiz \u015fekilde verilen kararlar neticesinde ba\u015fvurabilece\u011fi hukuki yollar kendisine anlat\u0131lmadan yap\u0131lan t\u00fcm i\u015flemler hukuka ayk\u0131r\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>3. GER\u0130 G\u00d6NDERME MERKEZ\u0130N\u0130N KO\u015eULLARI \u0130NSAN HAYS\u0130YET\u0130YLE BA\u011eDA\u015eMAMAKTADIR.<\/strong><\/p>\n\n\n\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u2026\u2026\u2026\u2026\u2026 Geri G\u00f6nderme Merkezi&#8217;nin yo\u011fun yap\u0131s\u0131, temizlik, sa\u011fl\u0131k, ki\u015fisel alan, havaland\u0131rma gibi hususlar\u0131n eksikli\u011fi, pencerelerde demir parmakl\u0131klar\u0131n olmas\u0131, \u00fclkemizde salg\u0131n haline gelen uyuz vak\u0131alar\u0131nda ya\u015fanan patlama, Covid-19 pandemisinin yeniden ba\u015fkaca varyantlarla artt\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnde m\u00fcvekkilin sa\u011fl\u0131\u011f\u0131 tehlike alt\u0131ndad\u0131r.
